Terms and conditions

Draft — must be checked by a lawyer before launch. Section 7, on the right of withdrawal, decides how a cancellation is handled and cannot go live in this form. The VAT position in section 4 depends on a tax question that is still open.

1. Who you are contracting with

That depends on where you order from. If you order from the European Union, your seller is Olha Loresh trading as a registered sole trader (Gewerbe) in Germany — the same business that prints and dispatches your set from Hamburg. If you order from Ukraine, your seller is Фізична особа-підприємець Лореш Ольга Юріївна (individual entrepreneur Olha Yuriivna Loresh), registered under № 2 585 000 0000 028268 of 20 April 2018.

The same person stands behind both, and the set, the price and the training are identical either way. Full details of both are in the imprint.

2. What these terms cover

They apply to the sale of the Sex&Money facilitator package in its three forms — €800, €1000 and €1200 — and to any training delivered with it. Nothing is sold through this website directly: you send an enquiry, we talk, and a contract comes into being only when we confirm your order in writing and you pay.

3. How an order is made

1. You send an enquiry through the form or by messenger.
2. We speak, usually for about half an hour. Certification is not automatic: it may be declined at this stage, and if so nothing is charged.
3. You choose an option and the language your set is printed in.
4. We confirm the order in writing, with the price, the language and the expected delivery date, and issue an invoice.
5. Payment makes the contract binding, and production begins.

4. Prices and payment

Prices are €800, €1000 and €1200. Delivery to any address in the European Union is included. Ukraine is served at the same prices.

No value added tax is added to these prices. For sales from the European Union the German seller is a small business under § 19 UStG and charges no VAT; for sales from Ukraine the sole trader is taxed under the single tax regime and is not registered for VAT. What you see is what you pay. The imprint notes two tax questions that are still with an adviser; neither of them changes the price you are quoted when your order is confirmed.

Payment is made by bank transfer to the seller's business account or by card, against an invoice issued after the order is agreed. Payment in parts is available through PrivatBank's Оплата частинами, which operates with cards issued in Ukraine.

Invoices inside Ukraine are issued in hryvnia, converted from US dollars at PrivatBank's rate on the day. Everywhere else the invoice is in US dollars, to the seller's foreign-currency account. Bank charges on a cross-border transfer are borne by the payer; where an intermediary bank deducts its own fee in transit, the shortfall is settled before the set goes to press.

5. Production and delivery

Every set is printed to order, in the language you choose, and dispatched from Hamburg, Germany. Because the parcel is sent from within the European Union, there is no customs clearance and no import duty for EU buyers.

• English, Russian or Ukrainian set, delivered in the EU: 14 days from receipt of payment.
• A language that must be translated first — German, Polish, Spanish and so on: 20 days from receipt of payment.
• Delivery within Ukraine: 10 days from receipt of payment.

These are working estimates for production plus transit. If a delay is unavoidable you will be told as soon as we know, with a new date. Risk of loss passes to you when the parcel is handed to you or to a carrier chosen by you.

Every set contains 50 printed player workbooks and 50 participant certificates (35 for women, 15 for men), together with the print-ready files for both, so that further copies can be printed by the facilitator at any time.

Inside Ukraine the set is sent by Ukrposhta or Nova Poshta. From the EU it goes by DHL as standard, and by Hermes, DPD, GLS, UPS or FedEx instead if you would rather have one of those — say which when you order.

6. What the training includes

• €800 — the printed set, both Miro boards, twelve months of the online game on this site, the method in writing, the marketing kit, the facilitator certificate and the commercial licence in section 8.
• €1000 — as above, plus the video course, voiced in your language.
• €1200 — as above, plus three live lessons with Olga Loresh of three hours each, held in Russian or in Ukrainian.

A trial game is part of certification in every option: you run one full session, online or in person, it is reviewed, and the certificate is then issued in your name.

The Miro boards are yours to keep. Access to the online game on this site runs for twelve months from delivery; after that it continues only by separate agreement. Renewal after that costs 96 USD a year.

The three live lessons in the €1200 option are to be taken within three months of purchase. Dates are agreed with you in advance; a session you cannot attend is moved once at no cost, and after that it is treated as taken. The written manual and the video course do not expire.

7. Right of withdrawal

This section is a placeholder and must be written by a lawyer. The points below are the ones that need deciding — they are not yet the terms.

• A consumer buying at a distance in the EU normally has 14 days to withdraw without giving a reason.
• Article 16(c) of the Consumer Rights Directive removes that right for goods made to the consumer's specifications or clearly personalised. Every set here is printed to order in a chosen language, and the certificate is issued in a named person's name, so the exception plausibly applies — but it only holds if the buyer is told about it clearly and in advance, which is what this section has to do.
• The video course is digital content. The right of withdrawal is lost only if the buyer gives express prior consent to immediate access and acknowledges losing that right. If the course is released before the set arrives, that consent has to be collected at the moment of purchase.
• Buyers who are businesses rather than consumers do not have a statutory right of withdrawal at all. Most buyers here are practitioners buying for their practice, so the terms should address both cases.
• A model withdrawal form and the exact instructions must be provided in a durable medium before the order is placed.

8. Your licence as a certified facilitator

Once certified you may run Sex&Money sessions commercially, for as long as you like, and you keep every fee you charge. There is no royalty, no ongoing fee and no obligation to report what you earn.

You may reprint the player workbooks for use at your own tables.

You may not: resell, copy or distribute the board or the card decks; publish the contents of the cards; teach the method to third parties as your own or as a course; present yourself as the author of the game; or transfer your certificate to another person. The game, its texts, its decks and its design remain the intellectual property of Olha Loresh.

A certificate is not withdrawn. It is issued once and stays with you: taking it back would mean taking back the set and returning what you paid for it, and that is not how this is sold.

What does exist is a complaints route. If a participant writes to us about how a session was run, we ask you for your account of it and the two are looked at together. Where something went wrong, the first step is a conversation and, if it helps, a session reviewed with Olga. A facilitator the complaints keep returning to stops being listed among those we refer players to, and stops being offered new material — neither of which touches the set you own or your right to run the game.

9. What the game is not

Sex&Money is a transformational game. It is not psychotherapy, medical treatment, psychological diagnosis or financial advice, and it is not sold as any of those. Facilitators must not present it as such, and participants remain responsible for their own decisions.

10. Complaints and defects

If a set arrives damaged, incomplete or misprinted, write within 14 days of delivery, with photographs, and it will be replaced at our cost. Statutory rights in respect of defective goods are unaffected.

11. Governing law

[To be settled by a lawyer, but the choice is now narrower than it was. Sales into the European Union are made by a seller established in Germany, so German law is the natural choice for them, with Ukrainian law for sales made from Ukraine. Whatever is chosen, a choice of law cannot deprive a consumer of the mandatory protections of the country where they live (Article 6 Rome I), and that has to be said plainly here. State the law, the venue, and include the link to the EU online dispute resolution platform, as in the imprint.]
